CPCC Submission to DOJ/FTC/HHS Request for Information Inquiry into Private Equity and Other Corporations’ Increasing Control Over Healthcare

Washington D.C. – On Wednesday June 5, 2024, the Coalition for Patient-Centered Care submitted a comment to the Justice Department’s Antitrust Division, Federal Trade Commission and Department of Health and Human Services cross-government public Request for Information (RFI) on Consolidation in Health Care Markets. 

Included in the submission are several testimonies. With the CPCC’s wealth of knowledge and experience with a diverse set of voices in healthcare, we have three distinct types of testimonials: 1) why independent practices are worth fighting for; 2) physician experiences with private equity in their practices; 3) industry experience and observations with private equity in healthcare.

Also in the submission are four implementations CPCC believes are needed to level the playing field with private equity firms in the healthcare sector: 1) Eliminate tax breaks for PE acquisitions of physicians; 2) close loopholes that allow PE to circumvent the ban on the corporate practice of medicine; 3) ensure PE-backed MSO’s are subject to the same requirements and regulations as independent physician practices such as Stark and Fraud and Abuse laws; 4) increased reporting and transparency requirements for PE acquisitions of physician practices.
